WHAT WE NEED FROM YOU
In addition to your contract
for our services, Fables Of The West respectfully requests the following:
-
A lockable dressing
room/storage area or a secured staging area out of the public view.

Bottled water following
performances.
-
A reasonable and agreed
upon minimal amount of 'comp' passes, if necessary.
-
Load in/load out vehicle
access.
-
Parking permits for all
days of event.
LODGING/HOTEL
ARRANGEMENTS
-
Hotel arrangements made by
the venue should be pre-arranged as follows:
-
Two single rooms or one double hotel
room
-
For fairs and events outside of
Southern California we are now requesting that hotels be reserved with
check in beginning the day prior to the event, with check out on the
day following the event. We have added this request because of the
logistics involved in travel arrangements and because of our commitment to
each event to arrive early on opening day and leave late on the closing
day. We will let you know in advance, however, if we are able to forego
either check in the day prior or check out the day after.

Fables Of The West understands that
the event will only be responsible for the lodging itself, and not
additional expenses that may be
incurred by group members during the stay (i.e. phone calls, key deposits,
etc).

Rooms should be booked under the name
'' Fables Of The West “or Ken McMeans (or the name of the team leader if
known).
-
We prefer 'non-smoking ' rooms, on
the first floor when available..
-
If at all possible, we would prefer
rooms with a microwave and/or small refrigerator.
SCHEDULING/WHAT WE DO
Fables Of The West requests
the flexibility of self-determining our daily performance schedule, with
start time and final approval by event management or entertainment
agency/department. It hinders our performances if locked into a strict time
schedule as part of what sets us apart from other acts is our desire to go
beyond 30 or 45 minute sets, and we are experienced enough to find and fill
the needs of a fair and its guests. The group agrees to perform a minimum of
two and a half hours daily, but often performs longer, and over a 5 to 7
hour shift time (but are more than willing to accommodate requests for early
AND late appearances during the fair hours, i.e. we can be at the fair
opening at 9am and still be available to warm up a concert audience or rodeo
crowd at 8pm).
In addition we welcome
the opportunity to perform at special events/functions you may have during
the event, including (but not limited to):

Warming up mainstage
concert audiences prior to headliner concerts or shows.

Introducing
mainstage concert acts
-
VIP/ Director's
Dinners or meetings
-
Charity events tied-
in with fair (on site or off)
-
School Tours
-
Parades
-
Audience warm-up for
rodeos
-
Working in the arena
during kid's rodeos (for 'Mutton Busting' /'Calf Scramble', etc)
-
Live media coverage
(TV broadcasts/promo/commercials/radio/newspaper interviews)
-
Emceeing or hosting
opening ceremonies
-
Judging competitions
(i.e. Talent Shows, Chili Cook-Offs, etc.)
-
Unusual special
requests (just ask us!)
Be assured that our price is
all-inclusive and there are no additional charges or expectations for any of
the above-mentioned special events.
We can be available for
media events prior to opening day of the event, schedule permitting, at no
charge, except for the hotel requirements. Please give us advance notice to
adjust travel arrangements.
CAST MEMBERS
Fables Of The West will have
three teams of two riders available for most of 2009.

Although Fables Of The
West will attempt to honor requests for specific performers at your event,
we cannot, however, guarantee performer availability.
-
Once routing and
scheduling is complete, we will try to provide you with bios and photos of
the cast members who will be appearing at your event. In most cases, this
is done electronically (high resolution photos are available from our
website-www.wildwestexpress.net). Please advise us if you would prefer
physical photocopies.

Please note that
currently, all of our cast members are being rotated, to provide re-booked
events with a unique and fresh dynamic each year. We guarantee that
you'll be satisfied with any combination of our current team leaders and
cast members.
INSURANCE REQUIREMENTS
-
Fables Of The West carries
full liability insurance in an amount that meets or exceeds all state
requirements (certificate available on request) and has no Workmen's
Compensation requirements. Our cast members are legally (as determined by
the Internal Revenue Service) subcontractors hired by Independent
Contractor Ken McMeans doing business as Fables Of The West.

Our current insurance
carrier is First Specialty Insurance, and CFSA is master certificate
holder for all California fairs, with approved Additional Wording on file.
-
Fairs outside of
California can be provided with specific Additional Insured wording upon
request. The additional wording often requested by fairs indemnifying
their county, state, staff, directors, etc. is actually covered by default
in its entirety by our policy. Nonetheless, we will provide you with the
additional wording specifically added to our certificate if you deem it
necessary. (There is a 48-hour minimum processing time upon request.)

Our insurance calendar
year runs from April 25 through April 25. As such, our insurance
certificates are not available until May 1 each year. We apologize to
fairs in May and June for the last minute nature of providing you with our
certificates, but rest assured that our coverage will always be current
and certificates provided by fair time.
CANCELLATION POLICY
Fables Of The West accepts
no cancellations inside of sixty days, except due to an act of God (flood,
tornadoes, etc.), terrorist catastrophe and/or in case of complete event
closure or cancellation. Rain is not considered a justifiable reason for
cancellation (see below.) Cancellations, outside of aforementioned
exceptions, will be assessed 50% of the agreed performance fees (plus any
court costs if legal action becomes necessary) when occurring less that 60
days prior to event. All cancellations within 30 days of event will be
assessed 100% of the agreed performance fees (plus any court costs if legal
action becomes necessary.)
IN THE EVENT OF RAIN
ARTIST may work in covered
areas or inside exhibit, vendor, and/or livestock buildings. ARTIST may
adjust the schedule to avoid heavy downpours, but will make a reasonable
effort to perform as scheduled.

RAIN IS NOT AN ACCEPTABLE
REASON FOR CANCELLATION, AS ARTIST CAN, WILL, AND DOES WORK IN INCLEMENT
WEATHER, WHEN NECESSARY, with the exception of severe or extreme
conditions that would put ARTIST and/or guests in danger.

ARTIST TO BE PAID FOR
DATES IN WHICH EVENT IS CLOSED PARTIALLY OR IN ITS ENTIRETY DUE TO RAIN.
-
IF RAIN FORCES PARTIAL
CLOSURE OF THE EVENT, ARTIST WILL BE AVAILABLE AT LOCATION UNTIL DISMISSED
AND WILL BE AVAILABLE UPON REOPENING. Artist will, when possible,
feasible, and reasonable, attempt to compensate with extra performances to
make up for lost scheduled time.
WORKMEN’S COMPENSATION
REQUIREMENTS
Fables Of The West is a sole
proprietorship founded, owned and operated by Ken McMeans. The business is
generally operated under the name Ken McMeans. Cast members are Independent
Contractors (or in many cases sub-contractors) and are not employees of
either the event or Ken McMeans. Fables Of The West has no Workmen’s
Compensation Insurance requirements, as determined and defined by the
Internal Revenue Service.
PAYMENT FOR
SERVICE/TAX I.D. INFO
-
Payment should be made
available no later than the final day of the event.
-
Checks should be made
payable to "Ken McMeans". (If event, State, or County policy requires
payment made reflecting the name of the act, it should not appear on the
Payline, and should be noted somewhere else on the check). Checks should
not be made payable to 'Fables Of The West ' or 'Wild West Express' as
that is the name of the act but not the name of the business and as such,
the bank frowns upon checks addressed in that manner. Checks made out
incorrectly will have to be returned to be reissued correctly.

In lieu of Ken McMeans
being present, the team leader will be approved to accept the check
(unless event is notified otherwise). Eric Holmquist is authorized to
accept checks on our behalf in all situations.
HARMONY ARTISTS
-
Jerry Ross and/or Adrienne
Crane have full power of attorney to negotiate and sign entertainment
engagement contracts on our behalf, for all events and venues and media
purposes (TV/film/radio appearances included).
-
They shall have the right
to negotiate sponsorships and similar contracts on our behalf.
-
In addition, Harmony
Artists has approval to pick up checks and/or set up a direct deposit
transaction, request or accept an advance deposit on behalf of Ken
McMeans, and handle all phases of negotiations, bookings, contracts,
documents, tax forms, and permits on our behalf, pertaining to our
entertainment business, for either that of Ken McMeans and/or Fables Of
The West.

Harmony Artists has the
additional power of attorney to cancel engagements if necessary.
Tax I.D. # Available on
request or by necessity.
This legally binding
agreement/contract is between event and Ken McMeans, (owner/operator of
Fables Of The West) whether negotiated by Ken McMeans or by Harmony Artists.
